Returns Policy

1. APPLICATION

This policy applies when you purchase any product from blackrhino-x.com.

This policy operates in conjunction with our General Terms and Conditions which is available at our Website. 

References to ‘us’, ‘we’ and ‘our’ mean Blackrhinox Pty Ltd ACN 660 607 616 and includes its related bodies corporate and associates as those terms are defined in the Corporations Act 2001 (Cth) and references to ‘you’ mean you.

 

2. DELIVERY

Delivery times may vary, and any estimates provided are subject to stock availability and delays which are beyond our reasonable control (including but not limited to postal delays or by something beyond our reasonable control).

 

3. RETURNS AND CHANGE OF MIND

Blackrhinox is happy to assist customers that wish to return or exchange Products purchased on our Website as follows.

3.1 Returns – quality and defects

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. 

You are entitled to a replacement or refund for a major failure and compensation for any other loss or damage that ought to have been reasonably foreseeable by us. 

You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure. 

If there is a problem with the Products you have purchased from us, you can return them to us. Upon assessment, we will offer a refund or replacement if there is major problem with the Products.  We may offer a repair or replacement if the problem is not major.

You must provide us with the order number which will appear on the invoice you will receive via email after making a purchase (Online Order Number). 

3.2 Returns – Change of mind 

We are not required to replace your product if you simply change your mind. However, if you are not happy with your product, we may, at our discretion, decide to exchange or provide you with a gift card, providing the product is returned to us in its original new condition with proof of purchase. If you wish to return Products because you have changed your mind about your purchase, we may offer you a refund provided that:

(a) You return the Products within 14 days from the purchase date. After this period, you may not be entitled to a refund or exchange.

(b) You produce your produce your Online Order Number when returning the Products.

(c) The Products have not been used or damaged in any way including that:

(i) they are in the original packaging, including any accessories and instruction manuals; and

(ii) they are unworn, unopened, unused and in its original condition.

(d) You agree to pay us the costs associated with the collection of the Products (whether we personally collect the Products or arrange a courier to do so) and an administration fee for processing the return.

All change of mind refunds are issued at the discretion of Blackrhinox.  We reserve the right to refuse a refund for a change of mind request if it does not comply with these conditions.

3.3 Return process

If you wish to return the Products (for either product failure or change of mind), the following process is to be followed:

(a) in the first instance, you should contact us (via telephone or email) and provide your Online Order Number, an explanation of the issue, and if possible, provide images (Claim). We will then try to assist you via telephone or email in respect of your Claim; and

(b) if your Claim is unable to be resolved by telephone or email, we will arrange a courier to collect your Products. Once your Products are received by us, we will undertake a thorough assessment and review. Following our review, we will determine whether it is appropriate to arrange a repair, replacement or refund of your Products as a result of the Claim, or alternatively decline the Claim and return the Products to you.

3.4 Returns period

Consumer guarantees under the Australian Consumer Law are not limited by a defined time period and can vary from product to product depending on factors such as the nature of Products, price and statements made on packaging and product labels. We assist you with further information about the warranty period for the product you return.

 

4. EXPENSES RELATING TO RETURNS AND REPAIRS

Any expenses relating to the return of your product to us will normally have to be paid by you. 

As per section 3.3, we may need to conduct an assessment of your product to determine whether a repair, replacement or refund is appropriate. Certain technical products may need to be sent to the manufacturer or their repair agent for assessment, such as:

4.1 sound, electrical and motor driven products;

4.2 BBQs; and

4.3 products determined at our discretion from time to time.

For some product assessments you may be required to liaise directly with the manufacturer, or their repair agent, selected by us. We can provide you with the relevant manufacturer contact details. In this circumstance, you would need to liaise with the repairer or manufacture to arrange drop off or collection of your Products.

 

5. EXCLUSIONS

In some cases, a refund, replacement, or repair may not be offered if:

5.1 the products are not compatible with your vehicle or boat (for instance, your vehicle or boat does not have an appropriate power source to run your Good);

5.2 you misuse the product contrary to user instructions or packaging labels or any other appropriately given warnings or disclaimers;

5.3 you use, connect, install or attempt to connected or instal the Products;

5.4 you damage the Products due to poor handling;

5.5 you use the Products for purposes other than those it was created or designed for;

5.6 you alter, modify or tamper with the Products, including whereby the Products are contaminated by foreign matter, foreign material or other products;

5.7 you use the product in an environment or circumstance that is not reasonable for a product of such nature, including incorrectly charging the Good; or

5.8 you simply change your mind.

 

6. AUSTRALIAN CONSUMER LAW

This policy, which excludes or limits our liability, shall apply only to the extent permitted by law.  Provisions of the Australian Consumer Law, and other statutes from time to time in force in Australia may apply warranties or conditions or impose obligations upon us which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extent. This policy shall be read and construed subject to any such statutory provisions. If any such statutory provisions apply, then to the extent to which we are entitled to do so, our, liability under those statutory provisions shall be limited to:

6.1 replacement of Products or the provisions of equivalent Products;

6.2 payment of the cost of replacing the Products or of acquiring equivalent Products; or

6.3 payment of the costs of repairing the Products; or

6.4 repair of the Products; or

6.5 refunding to you the costs of the Products in respect of the Products giving rise to the liability.

 

7. PRIVACY

In order for Blackrhinox to process your order we may collect your personal information, such as your name or contact details, including postal and email address and telephone number. Collection of your personal information will be managed in accordance with our Privacy Policy which is available at our Website.

 

8. INCONSISTENCY

In the event of any inconsistencies between this policy, our General Terms and Conditions and any other document or policy, this policy will prevail.

 

9. VARIATION

Blackrhinox reserves its rights to vary this policy without prior notice to you.
